Florida Auto Insurance Requirements in 2026: What You Need to Know

By ATSI Insurance Group

If you drive in Florida, understanding the state's auto insurance requirements is essential. Florida has unique insurance laws that differ from many other states, and knowing what coverage you need can save you from costly penalties and financial risk.

Florida's Minimum Auto Insurance Requirements

Florida requires all drivers to carry two types of coverage at minimum:

Personal Injury Protection (PIP): $10,000 minimum. Florida is a no-fault state, which means your own PIP coverage pays for your medical expenses regardless of who caused the accident. PIP covers 80% of medical expenses and 60% of lost wages, up to the policy limit.

Property Damage Liability (PDL): $10,000 minimum. This covers damage you cause to another person's property in an accident.

What Florida Does NOT Require (But You Probably Need)

Unlike most states, Florida does not require Bodily Injury Liability (BIL) coverage. However, going without it is risky. If you cause an accident that injures someone and their expenses exceed your PIP limits, you could be personally liable for hundreds of thousands of dollars.

We strongly recommend carrying at least $100,000/$300,000 in Bodily Injury Liability coverage along with Uninsured/Underinsured Motorist coverage to protect yourself from drivers who carry only the minimum.

Additional Coverage to Consider

Comprehensive Coverage: Protects against theft, vandalism, weather damage, and animal strikes. This is especially important in Florida where hurricanes and flooding are common.

Collision Coverage: Pays to repair or replace your vehicle after an accident, regardless of fault.

Uninsured Motorist Coverage: Florida has one of the highest rates of uninsured drivers in the country. This coverage protects you if you're hit by a driver who has no insurance.

Penalties for Driving Without Insurance in Florida

If you're caught driving without the required coverage in Florida, you could face license and registration suspension, reinstatement fees of up to $500, and a requirement to carry FR-44 insurance (higher liability limits) for up to three years.
